By accessing or using MailCannon ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

MailCannon is an email campaign management platform that allows users to create, schedule, and send email campaigns through connected email providers. The Service includes contact management, campaign sequencing, deliverability tracking, and MCP-based API access.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate, current, and complete information during registration.

4. Acceptable Use

You agree not to:

• Send spam, unsolicited bulk messages, or violate anti-spam laws (CAN-SPAM Act, GDPR, etc.)
• Use the Service for illegal purposes or to harass others
• Interfere with the Service's operation or security
• Access the Service through automated means beyond the provided API
• Use another user's account without permission

5. Email Compliance

Users must comply with all applicable email marketing laws, including providing accurate sender information, including a physical mailing address or PO box, providing a clear opt-out/unsubscribe mechanism in every email, and honoring unsubscribe requests promptly. MailCannon provides unsubscribe functionality for all campaigns.

6. Data Protection

We implement reasonable security measures to protect your data. You retain ownership of your contact lists and campaign content. We do not sell your data to third parties. See our Privacy Policy for details.

7. Third-Party Services

The Service integrates with third-party email providers (e.g., Gmail, Zoho Mail). Your use of those services is governed by their respective terms. MailCannon is not responsible for the availability or security of third-party services.

8. Limitation of Liability

MailCannon is provided "as is" without warranty of any kind. We are not liable for damages arising from your use of the Service, including but not limited to data loss, email delivery failures, or service interruptions.

9. Termination

We may suspend or terminate your account at any time for violation of these terms. You may delete your account at any time by contacting us.

10. Changes to Terms

We may modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the new terms.
